Mowze Privacy Policy

This Privacy Policy explains how Mowze collects, uses, shares, and protects information in connection with mowze.com (the "Site") and our commercial autonomous mowing products and services (together, the "Services"). By using the Site or the Services, you agree to the practices described here. This policy covers our commercial business, and our residential mowing service is described in a separate policy on its own website.

1. Information we collect

We collect information in three main ways: what you give us, what we collect automatically when you use the Site, and what our mowers and Services generate during operation.

Information you provide includes the details you enter when you place a reservation, request a demo, submit a contact or careers form, or otherwise communicate with us, such as your name, email address, phone number, company name, mailing or shipping address, job title, and anything you choose to include in a message. When you place a reservation, our payment processor collects your payment details to complete the charge, and we receive confirmation of the payment along with limited information such as the last four digits of your card, but we do not collect or store your full card number ourselves.

Information we collect automatically includes technical and usage data such as your IP address, browser and device type, pages you view, links you click, and the dates and times of your visits, gathered through cookies and similar technologies as described in Section 5.

Information generated by the mowers and Services includes operational and technical data produced while our equipment operates, which is addressed in detail in Section 4.

2. How we use information

We use the information we collect to operate and improve the Site and the Services, to process and manage reservations and the complimentary items associated with them, to schedule and conduct demos, to review job inquiries, to respond to your questions, to send you updates about your reservation and about product availability, to send marketing communications where permitted, to measure and improve how our Site and Services perform, to protect against fraud and misuse, and to comply with our legal obligations. Where we send marketing messages, you can opt out at any time using the unsubscribe link or by contacting us, though we may still send you messages necessary to administer an active reservation or account.

3. Payment processing

Reservation deposits and other payments are handled by third-party payment processors, and any card or banking details you enter are collected and processed by those providers under their own terms and privacy practices. Mowze does not receive or store your complete payment card information. We keep records of the transaction itself, such as the amount, date, and status, so we can administer reservations, issue refunds, and maintain our financial records.

4. Data from the mowers and Services

Our mowers and the systems that support them generate a range of operational data during setup and operation, which may include location and GPS data, property and route mapping, coverage and cut records, imagery and video captured by onboard cameras and sensors for navigation and obstacle detection, battery and charging telemetry, diagnostic and error data, software and firmware status, usage hours, and performance metrics (together, "Operational Data").

All Operational Data collected or generated by our mowers and Services is the property of Mowze. Mowze owns this data and the maps, models, analytics, and derived works created from it, and Mowze may use, store, reproduce, analyze, and build upon Operational Data for any lawful business purpose, including operating and improving the Services, developing and training our products and autonomy systems, maintaining safety and reliability, and supporting our customers. If you are a customer using our equipment or services, you grant Mowze the rights necessary to collect, retain, and use Operational Data as described here, and this ownership and these rights continue after your reservation, lease, or service arrangement ends.

Because our mowers use cameras and sensors to navigate safely, Operational Data may at times include imagery of surrounding areas, property, or people. We collect and use this imagery for navigation, safety, operations, and improvement of the Services, and we handle it in line with this policy. Where Operational Data can be reasonably associated with an identifiable individual, we treat that portion as personal information under this policy and apply the protections described in the sections below. We may also publish or share aggregated or de-identified data, such as total acres cut or fleet-wide performance figures, that does not identify any individual.

5. Cookies, analytics, and advertising

We use cookies and similar technologies to run the Site, remember your preferences, understand how the Site is used, and support our marketing. This includes analytics tools that help us measure traffic and performance, and advertising technologies, sometimes called pixels or tags, that help us reach relevant audiences and measure the results of our campaigns. You can control cookies through your browser settings, and disabling some cookies may affect how the Site works. Depending on where you live, our use of certain analytics and advertising cookies may be considered a "sale" or "sharing" of personal information under applicable law, and you can exercise the choices described in Section 8.

6. How we share information

We do not sell your personal information for money. We share information in the following limited circumstances: with service providers who perform functions on our behalf, such as website hosting, payment processing, analytics, advertising, email delivery, and fulfillment of promotional items, and who are permitted to use the information only to provide those services; when required to comply with the law, respond to legal process, or protect the rights, safety, and property of Mowze, our customers, or others; and in connection with a merger, acquisition, financing, or sale of all or part of our business, in which case information may be transferred as part of that transaction. As noted in Section 5, our use of advertising and analytics technologies may be treated as "sharing" of personal information for advertising purposes under some state laws.

7. Data retention and security

We keep personal information for as long as needed to provide the Services, administer reservations and accounts, comply with our legal and financial obligations, resolve disputes, and enforce our agreements, after which we delete or de-identify it. Operational Data may be retained on the longer terms described in Section 4. We use reasonable administrative, technical, and physical safeguards designed to protect information, though no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Your choices and rights

You can ask us to access, correct, update, or delete personal information we hold about you, and you can opt out of marketing communications at any time. Depending on your state of residence, you may have additional rights, such as the right to know what personal information we collect, the right to request deletion, the right to correct inaccurate information, and the right to opt out of the sale or sharing of personal information for targeted advertising. To exercise any of these rights, contact us at info@mowze.com, and we will respond as required by applicable law. We will not discriminate against you for exercising your rights. Please note that requests relating to personal information do not extend to Operational Data owned by Mowze except to the extent that data can be reasonably associated with you as an identifiable individual.

9. Children's privacy

The Site and Services are intended for businesses and adults, and are not directed to children. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

10. Notice to individuals on your property

If you are a customer, you are responsible for providing reasonable notice to your employees, guests, and other individuals who may be present on the property where the Mower operates that the Mower is equipped with cameras and sensors that may capture imagery of the surrounding area and for obtaining any consents required under applicable law for that imagery to be captured on your property.

11. Scope of this Policy

This Policy is intended for Site visitors, reservation holders, and customers located in the United States, and it is designed to comply with applicable U.S. federal and state privacy laws. This Policy does not address, and Mowze does not represent compliance with, the privacy laws of other countries or regions, including the European Union's General Data Protection Regulation. If you access the Site or Services from outside the United States, you do so on your own initiative and are responsible for compliance with applicable local laws.

12. Limitation of liability

To the fullest extent permitted by law, Mowze will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to the collection, use, or handling of information under this Policy. Where applicable law permits a limitation of liability, our total liability for any claim relating to this Policy will not exceed the amount, if any, you paid to Mowze in the twelve months preceding the claim.

13. Governing law and dispute resolution

This Policy is governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. Any dispute relating to this Policy that also relates to a reservation, purchase, or other agreement you have with Mowze will be resolved as provided in the dispute resolution provisions of that agreement, including any arbitration and class-action waiver provisions there. Where no such agreement applies, any dispute relating to this Policy will be brought in the state or federal courts located in Maryland, and you consent to the jurisdiction of those courts and waive the right to a jury trial to the fullest extent permitted by applicable law.

14. Changes to this policy

We may update this Privacy Policy from time to time, and we will post the current version on the Site with a revised effective date. If we make material changes, we will take reasonable steps to let you know, and your continued use of the Site or Services after an update means you accept the revised policy.
