1. Acceptance of these Terms
Welcome to Mowze. These Terms of Use ("Terms") govern your access to and use of the Mowze website (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
These Terms apply to your use of the Site itself. If you place a reservation, that transaction is separately governed by our Reservation Terms, and our handling of your personal information is governed by our Privacy Policy. In the event of a conflict, the Reservation Terms control for matters relating to a reservation, and the Privacy Policy controls for matters relating to personal data.
2. Eligibility
The Site is intended for business customers located in the contiguous United States. By using the Site, you represent that you are at least 18 years old and able to enter into a binding agreement.
3. Informational Nature of Site Content
The Site describes Mowze products, including autonomous electric commercial mowers, that are offered on a pre-order or reservation basis. Product descriptions, specifications, features, images, availability, pricing, and timelines are provided for general informational purposes, are subject to change without notice, and may not reflect the final delivered product. Nothing on the Site constitutes a binding offer, warranty, or guarantee regarding any product or its performance. You should not rely on Site content as the sole basis for any purchasing or business decision.
4. No Warranties
The Site and all content on it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Mowze does not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the Site is accurate, complete, or current. This section does not affect any warranty that may separately apply to a product you reserve or purchase.
5. Limitation of Liability
To the fullest extent permitted by law, Mowze and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of or inability to use the Site or reliance on any Site content, regardless of the legal theory and even if advised of the possibility of such damages. To the fullest extent permitted by law, Mowze's total liability arising out of or relating to the Site will not exceed one hundred U.S. dollars (US $500).
6. Intellectual Property
All content on the Site — including the Mowze name and logo, text, graphics, images, product designs, and the selection and arrangement of that content — is owned by or licensed to Mowze and is protected by intellectual property laws. You may view and use the Site for your own legitimate business evaluation purposes. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Site content without our prior written permission.
7. Acceptable Use
You agree not to use the Site in any way that violates any applicable law; infringes the rights of others; introduces malware or otherwise attempts to interfere with, disrupt, or gain unauthorized access to the Site or its systems; scrapes, harvests, or collects information about other users; or misrepresents your identity or affiliation. We may suspend or terminate your access to the Site at any time, with or without notice, for conduct we believe violates these Terms or is otherwise harmful.
8. Third-Party Links and Services
The Site may contain links to third-party websites or services, and may rely on third-party providers for functions such as payment processing, analytics, and advertising. Mowze does not control and is not responsible for the content, policies, or practices of any third party. Your use of a third party's site or service is governed by that party's own terms and policies.
9. Changes to the Site and to these Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also revise these Terms from time to time. The "Last updated" date above indicates when these Terms were last revised. Your continued use of the Site after a change takes effect constitutes your acceptance of the revised Terms.
10. Governing Law and Disputes
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts.
11. Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
